e-ran Partner Riders: Policies, Terms, and Conditions

Welcome to e-ran Online Delivery and Emergency Services, Inc. (hereinafter referred to as "e-ran"). By signing up as an e-ran Partner Rider, you agree to the following terms and conditions, which govern your relationship with e-ran and your responsibilities as a service provider. These policies are designed to ensure a safe, secure, and professional environment for all parties using the platform, especially regarding the protection of user data and privacy.


1. Role and Responsibility

As an e-ran Partner Rider, you are an independent contractor who provides delivery services using the e-ran platform. You are not an employee of e-ran but rather a service provider operating under the platform. You are responsible for ensuring that deliveries are completed in a timely and professional manner, while maintaining the highest standards of service and customer satisfaction.

2. Compliance with Data Privacy Laws

You acknowledge that e-ran operates in full compliance with the Data Privacy Act of 2012 (Republic Act No. 10173) of the Philippines and other relevant privacy regulations. As a Partner Rider, you are required to handle client and user information responsibly and in compliance with these laws.

3. Location Information

We, our service providers, and Advertising and Analytics Vendors (see Section 2 for more information) may collect location information through the Services. We may share the location information we collect with third parties as addressed in Section 3.

We collect location information to provide you with location-based services (such as severe weather alerts, air quality, and other weather information through our mobile applications), provide advertisements that are relevant to your geographic location, and conduct analytics to improve the Services. The type of location information we collect depends on your settings in the device you use to access the Services.

If you are accessing the Services through the Site, we may detect your general location so that we can automatically show you the weather for your general area. Depending on browser type and configuration, your browser may inform you that the Site would like to collect your specific location and request your permission to do so. If you do not allow it, or your browser does not permit it, only your general location information is then collected and may be stored locally on your device. You may always manually enter a location (such as city, postal code, and country). On mobile web, if you opt out of sharing your current location, you may continue to receive content that is relevant for the city you have entered in the search bar (i.e., contextual city name).

If you access the Services on your mobile device, we may directly collect precise geographic location information and sensor data via Global Positioning System (GPS), cellular network information, and other location-based features. We typically receive the latitude and longitude of your mobile device, as well as date and time and sensor data such as altimeter. Factors such as device and operating system determine the accuracy of this latitude and longitude and how closely it corresponds with your device's location.

Location-related information: We use location-related information—such as your current location, where you live, the places you like to go, and the businesses and people you're near—to provide, personalize, and improve our Products, including ads, for you and others. Location-related information can be based on things like precise device location (if you've allowed us to collect it), IP addresses, and information from your and others' use of Facebook Products (such as check-ins or events you attend).

Geolocation Information: If you turn these features on, when you use your mobile, we will collect information about WiFi access points as well as other location information about your longitude and latitude and may save your device's coordinates to offer certain features to you. This information helps us identify your physical location and we may use it to personalise the App and make it easier for you to interact with other Users, by enabling the information to be displayed and shared with other members choosing to view "nearby" posts.

If you have enabled location services, but wish to turn them off, you can do so by the following methods:

5. Intellectual Property

All intellectual property rights in the e-ran app, website, and platform remain the property of e-ran. As a Partner Rider, you are granted a limited, non-exclusive, and revocable license to use the e-ran platform solely for the purpose of providing delivery services.

You will receive compensation based on completed deliveries as specified in the e-ran Partner Rider Agreement. Payments will be disbursed according to the schedule and process outlined in your contract with e-ran.

e-ran reserves the right to update or amend these policies, terms, and conditions from time to time. Any changes will be communicated to you, and your continued use of the platform signifies acceptance of the updated terms.

11. Dispute Resolution

In the event of a dispute between you and e-ran, both parties agree to resolve the matter through mediation and, if necessary, arbitration, as governed by the laws of the Philippines.

These terms and conditions are governed by and construed in accordance with the laws of the Republic of the Philippines.
